Terms of service

Welcome to EJN Design Studio. By accessing our website (ejndesignstudio.com.au) or engaging our services, you agree to the following terms.

1. Engagement and Scope

All services provided are based on the specific Quote or Proposal provided to the Client. Any work requested outside of the original "Scope of Work" will be treated as a variation and may incur additional fees.

2. Payment Terms

Deposits: A non-refundable deposit of 50% is required before work commences.

Final Payment: The remaining balance is due upon approval of final drafts and before the delivery of final source files or website launch.

Late Payments: We reserve the right to suspend work or withhold deliverables if invoices are overdue by more than 14 days.

3. Intellectual Property (IP)

Ownership: Upon receipt of full payment, EJN Design Studio grants the Client a license to use the final designs for their intended purpose.

Preliminary Work: We retain ownership of all unused concepts, drafts, and preliminary sketches created during the process.

Portfolio Rights: Unless otherwise agreed in writing, we reserve the right to display the completed work in our professional portfolio and marketing materials.

4. Client Responsibilities

The Client agrees to provide all necessary materials (logos, text, images) in a timely manner. Delays in providing feedback or materials may result in extended project timelines. EJN Design Studio is not responsible for errors in content provided by the Client.

5. Revisions

Our standard packages include 3 rounds of revisions. Additional revisions beyond this will be charged at our standard hourly rate.

6. Australian Consumer Law & Refunds

Our services come with guarantees that cannot be excluded under the Australian Consumer Law.

Refunds: We do not offer refunds for "change of mind" once work has commenced.

Remedies: If a service fails to meet a consumer guarantee, you are entitled to have the issue rectified within a reasonable time. If the failure is major, you may cancel the service and request a refund for the unused portion.

7. Limitation of Liability

To the extent permitted by law, EJN Design Studio is not liable for any indirect or consequential loss, including loss of profits or business reputation, arising from the use of our designs or website services.

8. Jurisdiction

These terms are governed by the laws of Victoria, Australia.
